These Guest WiFi Terms of Service and Acceptable Use Policy (“Guest WiFi Terms”) govern your access to and use of the wireless internet service (“Guest WiFi Service” or “Service”) made available at the property through network infrastructure and internet connectivity provided by STS.

The Guest WiFi Service is provided to the Property Management Company, Owner, HOA or management entity of the property (“Property”) as part of the internet services STS supplies to the Property. STS installs and maintains the Access Points and related equipment at the Property’s request to enable guest/resident network access. The Guest WiFi Service is offered to residents, tenants, and authorized guests of the Property (“You”, “Your”, or “User”) solely as a convenience.

BY CONNECTING TO, ACCESSING, OR USING THE GUEST WIFI NETWORK, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE GUEST WIFI TERMS, THE STS GENERAL TERMS OF SERVICE AVAILABLE AT https://southeasttelephone.net/TermsofService (INCORPORATED HEREIN BY REFERENCE), AND STS’S ACCEPTABLE USE POLICY.

If you do not agree to these terms, do not connect to or use the Guest WiFi Service.

1. Description of the Guest WiFi Service

The Guest WiFi Service is a shared, best-effort wireless internet access service delivered over STS-provided infrastructure. It is intended for general web browsing, email, and light personal use.

No guarantees are made regarding speed, bandwidth, latency, uptime, availability, or suitability for any particular purpose, including VoIP, video conferencing, streaming, gaming, large file transfers, remote work, or any critical or business use or time-sensitive use. Performance may vary based on the number of connected devices, network congestion, your location within the property, device capabilities, and other factors. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

2. Acceptable Use and Prohibited Activities

You agree to use the Guest WiFi Service in compliance with all applicable federal, state, and local laws, as well as the STS General Terms of Service and Acceptable Use Policy.

Prohibited activities include, but are not limited to:

Any illegal activity or transmission of unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene content
Spamming, phishing, or sending unsolicited bulk communications
Hacking, unauthorized access, scanning, or probing of networks or systems
Distribution of malware, viruses, or other malicious code
Excessive bandwidth consumption (e.g., sustained high-volume downloads/uploads, torrenting, or server hosting) that degrades service for other users
Circumventing or attempting to circumvent any security, filtering, or access controls
Any activity that interferes with or disrupts the Service, STS network, Property network, or other users

STS and/or the Property reserve the right, in their sole discretion, to monitor usage, block access to certain content or sites, and take any action necessary to protect the network, other users, or to comply with legal obligations.

3. No Expectation of Privacy; Monitoring and Logging

You have no expectation of privacy when using the Guest WiFi Service. The network is a shared resource. STS and/or the Property may monitor, log, and retain information about your usage, including but not limited to device identifiers (MAC addresses), connection times, bandwidth consumption, and websites or services accessed, for purposes including network management, security, abuse prevention, and legal compliance.

By using the Service, you consent to such monitoring and logging.

4. User Responsibilities and Device Security

You are solely responsible for:

The security and configuration of your own devices, including installing and maintaining antivirus, firewall, and operating system updates
Any content you access, download, or transmit while using the Service
Ensuring your use complies with any additional rules, policies, or lease/HOA requirements of the property

STS and the Property are not responsible for viruses, malware, data loss, or security breaches affecting your devices or data.

5. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GUEST WIFI SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. STS AND THE PROPERTY MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

STS and the Property make no warranty that the Service will be uninterrupted, secure, error-free, or meet your requirements. STS exercises no control over the content, information, or materials accessed via the internet.

6. Limitation of Liability

IN NO EVENT SHALL STS, SOUTHEASTERN POOLPHONE SERVICE, INC., THE PROPERTY, OR ANY OF THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE GUEST WIFI SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Your sole remedy for any dissatisfaction with the Service is to discontinue use. Some jurisdictions do not allow the exclusion or limitation of certain liabilities; in such cases, liability shall be limited to the maximum extent permitted by applicable law.

7. Indemnification

You agree to indemnify, defend, and hold harmless STS, Southeastern Poolphone Service, Inc., the Property, and their respective affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Guest WiFi Service
Your violation of these Guest WiFi Terms or any applicable law
Any content you transmit or access while using the Service
Any claim by a third party related to your use of the Service

8. Suspension and Termination

STS and/or the Property may suspend, restrict, or terminate your access to the Guest WiFi Service at any time, with or without notice, for any reason, including but not limited to:

Violation of these Guest WiFi Terms or the STS Acceptable Use Policy
Network maintenance, upgrades, or protection
Excessive or abusive use
In the sole discretion of STS or the Property

Upon termination or suspension, your right to use the Service immediately ceases.

9. Governing Law and Dispute Resolution

These Guest WiFi Terms shall be governed by and construed in accordance with the laws of the State of North Carolina and applicable federal law of the United States, without regard to conflict of law principles. Any dispute arising under or relating to these terms shall be resolved exclusively in the state or federal courts located in the home jurisdiction of STS. You waive any right to a jury trial and agree not to participate in any class action or consolidated proceeding.

10. Modifications

STS and/or the Property reserve the right to modify these Guest WiFi Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the modified terms. The most current version will be available upon request or as otherwise provided by the Property.

12. Entire Agreement and Severability

These Guest WiFi Terms, together with the STS General Terms of Service, found at https://southeasttelephone.net/TermsofService, constitute the entire agreement between you and STS regarding the Guest WiFi Service and supersede all prior agreements or understandings. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
